Terms & Conditions for Charity Redemption
Definition
The following words and expression shall, unless the context otherwise requires, have the meanings assigned to them:
"Charity organization"
is a charitable concern that that provides charity related services to the public with a registered office in Pakistan with an official designated bank account to whom HSBC Credit Card customers can send donations to through HSBC Premier's Charity Redemption Programme.
"HSBC Credit Card"
means HSBC Premier Credit Cards.
"HSBC Group"
means all legal entities, subsidiaries, branch offices and associated companies around the world of HSBC Holdings Plc which is incorporated in London, UK.
"Customers"
mean customers of HSBC using HSBC Premier Credit Card.
"Charity"
means acts of kindness carried out by the Charity organization, with the intention of providing a better life to its stated beneficiaries, in line with the stated purpose and activities of SOS, using its available and contributed funds.
"Customer Services Centre"
refers to HSBC's Call Centre for Premier Credit Card Customers.
"Written Contribution Order"
means any payorder and/or cheque made in the favour of the Charity organization's registered bank account number, which is meant for official use by the charity organization as per its stated objectives, procedures, rules, guidelines - in concurrence of local regulations.
"Banking Corporations"
means a Company engaged in providing financial services to individual and corporate customers as per the Banking Companies Ordinance 1962 and is regulated by the State Bank of Pakistan.
"Point Conversion"
means HSBC charity redemption scheme which enables Customers to redeem their earned reward point against charity to SOS.
Charity Contribution Plan
HSBC shall under the Charity Contribution Plan (CCP) facilitate the Customers to contribute money to the Charity organizations from time to time through the 'Point Conversion' Scheme. Under the Point Conversion Scheme HSBC shall give an option to the Customers to convert their Reward Points, earned on spending money using HSBC Premier Credit Card, to money that shall be contributed to the Charity organization's charitable activities via Pay Order or cheque to be given to the Charity organization's official account as designated by the Charity organization and as provided by the Charity organization's authorized person, as mutually agreed by all Parties.
The CCP shall be made available to Customers applying through HSBC Premier hotline by HSBC. The Customer will earn the Reward Points by spending on HSBC Credit Card. The Customer would request for the redemption of the accumulated reward points through Customer Services Centre or any other channel deemed fit by HSBC, which will be converted to the Written Contribution Order.
Execution of Charity Services
Subject to the receipt of Written Contribution Order by the Charity organizations from HSBC as per its specifications, the Charity organization shall use the contributed money for its charitable activities only in a beneficial manner with the intention of obtaining the Charity organization's stated goals, and the Charity organizations themselves shall be responsible for ensuring that the money contributed by HSBC is used only by the Charity organizations and for charitable purposes only.
HSBC acknowledges and agrees that the time for and specific manner of utilizing the contributed money for charitable causes may vary according to SOS requirements and at its reasonable discretion.
Liability for Misuse of Contributed Money
HSBC is not to be held liable for ensuring that the Charity organizations use their money for charitable purposes only; HSBC's responsibility is limited to ensuring that the money contributed by Customers is delivered to Charity organizations safely and efficiently.
Charity organizations are not to use funds contributed by HSBC to sponsor or aid any activities termed as illegal or generally considered to be unethical. The money contributed by HSBC is not to be used to sponsor any acts of terrorism or violence, nor shall it be used to the benefit of, whether directly or indirectly, any groups engaging in the same.
Complaint Handling
Charity organizations will be responsible for any issues/complaints that may arise out of any services executed by Charity organizations using the funds provided by HSBC. Charity organizations shall solely be responsible for the results, consequences or liabilities arising from the use of funds.
Governing Law
This programme shall be governed by and construed in accordance with substantive and procedural laws of the Islamic Republic of Pakistan.
